Welcome to our website. The terms “we”, “us”, “our”, and “Bushwise Academy” refer to The Bushwise Academy NPC, a registered Public Benefit Organisation (“PBO”). These Terms of Use (“Terms“) constitute a legally binding agreement (“Agreement“) between you and Bushwise Academy governing your access to and use of the Bushwise Academy website, including any subdomains thereof, and any other websites through which Bushwise Academy makes its services available (collectively, the “Site“). Our Privacy Policy and any Cookie Policy applicable to your use of the Site are incorporated by reference into this Agreement.

 

PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE YOU START TO USE OR ACCESS THE SITE, AS THESE TERMS WILL APPLY TO YOUR USE AND ACCESS OF THE SITE. WE RECOMMEND THAT YOU PRINT A COPY OF THESE TERMS OF USE FOR FUTURE REFERENCE.

INFORMATION ABOUT US

 

The Site is operated by The Bushwise Academy NPC. We are registered as a PBO in the Republic of South Africa under company number 2024/197950/08 and have our registered office at Unit 7, Westlake Business Park, 7 Stibitz Street, Tokai, Cape Town, 7945. We are a non-profit company.

 

CHANGES TO THESE TERMS

 

Bushwise Academy may, at any time and in its sole discretion, amend, modify, delete or add (collectively “Amendments”) to these Terms. Your use of the Site after such Amendments have been posted constitutes your agreement with and acceptance of such Amendments.

 

Please check this page from time to time to take notice of any Amendments we made, as they are binding on you.

 

CHANGES TO SITE AND SERVICES

 

Bushwise Academy may, at any time and in its sole discretion, modify, add to, delete, suspend or terminate the Site and any content, services or material offered on or throughout the Site, for any or no reason, and with or without notice. However, please note that any of the content on the Site may be out of date at any given time, and we are under no obligation to update it.

 

We do not guarantee that the Site, or any content on it, will be free from errors or omissions.

 

INTELLECTUAL PROPERTY OWNERSHIP

 

All information, materials, images, software, photographs, articles, functions, text and other content (collectively, “Content”) contained on or offered through the Site and all copyrights, trademarks, and other intellectual property rights in or relating to the Content are the sole property of Bushwise Academy, its licensors or content providers or other third parties. The Site and all of its Content and the selection and arrangement thereof, is protected as a compilation owned by Bushwise Academy under the copyright laws and treaties around the world. Bushwise Academy may change the Site or delete any Content or features or services at any time, in any way, for any or no reason. Bushwise Academy reserves all rights not expressly granted in and to the Site and the Content.

 

Unless otherwise noted, Bushwise Academy and all other trademarks, service marks, trade names, and logos displayed on the Site are the trademarks, service marks, trade names, and logos of Bushwise Academy. All other trademarks, logos and service marks are the property of their respective owners. Nothing on the Site shall be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark, trade name, logo or service mark displayed on the Site without the owner’s prior written permission. Unauthorised use of Bushwise Academy and all other trademarks, service marks, trade names, and logos displayed on the Site is strictly prohibited.

 

You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or our licensors.

 

USE OF THE SITE

 

Content may not be copied, reproduced, republished, uploaded, posted, re-delivered using framing technology, transmitted, displayed, performed, distributed or used in any way without Bushwise Academy’s prior written permission; provided however, that users may download one copy of any Content on any single computer and print a copy of that Content solely for their personal, private, non-commercial use. No permission is granted to use the Site icons, addresses or other means to hyperlink other web sites with any page in the Site.

 

NO RELIANCE ON INFORMATION

CHILDREN’S PRIVACY

 

We are committed to protecting the privacy of children. This Site is not intended or designed to attract children under the age of 18. Bushwise Academy will only process personal data of children aged below 18 with the consent of their parent or legal guardian. If we become aware that you are under 18 and are attempting to or have submitted personal information via the Site without your parent/guardian’s permission, we will not accept such information and we will take steps to remove such information from our records. This may involve us having to access and verify your age and other relevant details.

 

THIRD PARTY CONTENT

 

Bushwise Academy may from time to time post content supplied by third parties and users (collectively “Third-Party Content”). Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties in the Third-Party Content are those of the respective author(s) or distributor(s) and not of Bushwise Academy. Bushwise Academy does not guarantee the accuracy, completeness, or usefulness of any Third-Party Content, nor its merchantability or fitness for any particular purpose. Additional disclaimers and limitation of liability are noted below.

 

LIMITATION OF OUR LIABILITY

 

The use of the Site and the Content is at your own risk.

 

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by South African law.

Bushwise Academy makes no representation or warranty as to the accuracy or any other aspect of the information on such Third-Party Sites.

 

INDEMNITY

 

You agree to defend, indemnify, and hold Bushwise Academy, and their officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your breach of these Terms.

 

GENERAL

 

Bushwise Academy is based in the Republic of South Africa. We make no claims that the Site and the Content are appropriate or may be downloaded outside South Africa. Access to the Content may not be legal by certain persons or in certain countries. If you access the Site from outside South Africa, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

 

The following provisions survive the expiration or termination of these Terms for any reason whatsoever: Liability, User Submissions, User Submissions — image, video, audio files, Indemnity, Jurisdiction, and Complete Agreement. 

 

JURISDICTION AND APPLICABLE LAW

 

You expressly agree that exclusive jurisdiction for any dispute with Bushwise Academy, or in any way relating to your use of the Site, resides in the courts of Republic of South Africa and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of Republic of South Africa in connection with any such dispute including any claim involving Bushwise or their affiliates, subsidiaries, employees, contractors, officers, directors, telecommunication providers, and content providers.

 

These Terms are governed by the laws of South Africa without respect to its conflict of laws principles. If any provision of these Terms is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any of the provisions of these Terms shall be deemed a further or continuing waiver of that provision or any other provision of these Terms.

• Identification of the copyrighted work that you believe to be infringed. Please describe the work, and where possible include a copy or the location (e.g., URL) of an authorised version of the work.

COMPLETE AGREEMENT

 

Except as expressly provided in a particular “legal notice” on the Site, these Terms and our Privacy Policy constitute the entire agreement between you and us with respect to the use of the Site, and Content.
